Shop Promise Merchant Terms
These Shop Promise Terms of Service (“Shop Promise Terms”) govern your use of Shop Promise, a Shopify-branded trust badge, signaling to customers that they can expect a premium experience, such as delivery in 5 days or less (“Shop Promise”). By using Shop Promise, you represent that you have read, understood, and agree to these Shop Promise Terms, together with any and all rules, policies and guidelines provided by Shopify including our Terms of Service and Privacy Policy (collectively, the “Agreement”). Terms not defined in these Shop Promise Terms have the same meaning set out in the Terms of Service.
For the avoidance of doubt, Shop Promise is a “Service” under the Terms of Service. In the event of a conflict between the Shop Promise Terms and the Terms of Service, the Shop Promise Terms will govern with respect to Shop Promise.
Shopify reserves the right to update and change the Shop Promise Terms by posting updates and changes to the Shopify website. You are advised to check the Shop Promise Terms from time to time for any updates or changes that may impact you. If you do not accept such changes/amendments, you must cease using Shop Promise.
1. Shopify’s Rights
- Shopify may communicate the procedures, policies, and delivery standards governing Shop Promise, as may be updated from time to time (the “Shop Promise Delivery Standards”) to you via your Shopify Admin, email, or any other means, as determined in our sole discretion.
- Shopify may determine whether items in your store are eligible for Shop Promise and whether or where to display the Shop Promise badge, including in a customer’s cart.
- Shopify reserves the right (at its sole discretion) and for any reason to disable Shop Promise from your store.
2. Your Responsibilities
To be eligible to use Shop Promise you must:
- Have an active subscription to a Basic Shopify plan or higher.
- Have Shop Pay activated.
- Have an active Shopify Payments account.
- Be using the latest version of Shopify’s features, products and programs.
- Have never violated the Shopify Acceptable Use Policy.
To use Shop Promise you agree to:
- Use Shop Promise in accordance with the Shop Promise Delivery Standards.
- Allow Shopify to communicate predicted delivery dates to your customers on your behalf.
- Not modify the Shop Promise badge or delivery date estimates provided by Shopify, or otherwise alter the functionality of Shop Promise.
Relationship between you and Customer
- The sale of goods or services is solely between you (the merchant) and your customer. Shopify is not a party to these transactions.
- Shopify is not and will not be responsible for any aspect of the products you sell
- Shopify is not responsible for the acts of your customers.
- Except for inquiries related to customer claims against the Limited Guarantee (defined below), you are solely responsible for investigating and resolving disputes with your customers, and Shopify will not intervene in or be responsible for any disputes.
3. Limited Guarantee & Use of Data
- When you are using Shop Promise, a limited guarantee is provided on eligible orders with the Shop Promise badge to your customers at no cost to the Merchant or customer (“Limited Guarantee”). The Limited Guarantee is further described in and governed by the Shop Promise Customer Facing Policies, and may be changed, modified and amended in Shopify’s sole discretion.
- If the first delivery attempt was later than the Shop Promise provided date, the customer may be eligible to receive a certain amount of Shop Cash, subject to the Shop Rewards Terms and Conditions.
- You direct and authorize Shopify to use your customer order data to provide the Limited Guarantee.
4. Term and Termination
- In addition to Shopify’s termination rights in the Terms of Service, Shopify may terminate these Shop Promise Terms at any time for any reason.
